Terms of Service

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE. BY USING OR ACCESSING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT USE THE SERVICE.


These Terms of Service (the "Terms") govern your use of the FunDayTeam website and game service (the "Service") operated by FunDayTeam ("we", "us", "our"). If you have any questions, please contact us at hello@nieuventures.com.


FunDayTeam operates under and abides by the laws and regulations of the Republic of South Africa.


These Terms are a binding agreement between you and FUNDAYTEAM. Your use of the Service in any way means you agree to all of these Terms, and they will remain in effect while you use the Service. These Terms include this document and our Privacy Policy.


About the Service

FunDayTeam is a real-time, multiplayer quiz game designed for remote engineering teams. The Service allows a host to create a game room, share a join code, and play AI-generated quiz rounds with other players. Game content is generated by artificial intelligence from publicly available tech news sources.


The Service has two types of users:

  • Hosts — sign in with a Google account to create and manage game rooms.
  • Players — join game rooms with a display name and join code. No account or registration is required.

Changes to these Terms

We may update these Terms from time to time. If we make changes, we will update the Terms on this page. Your continued use of the Service after changes are posted means you accept the updated Terms. If you do not agree with the changes, you should stop using the Service.


Privacy

Your use of the Service is subject to our Privacy Policy, which explains what data we collect and how we use it. We use third-party analytics tools (including Mixpanel) to understand usage patterns and improve the Service. By using the Service, you consent to the collection of usage data as described in our Privacy Policy.


We do not knowingly collect personal information from anyone under the age of 13. If you are under 13, please do not use the Service. If you believe a child under 13 may have provided us with personal information, please contact us at hello@nieuventures.com.


Using the Service

Host accounts

Hosts sign in via Google OAuth. You agree to keep your account credentials secure and are responsible for any activity that occurs under your account. You may not transfer your account to anyone else without our written permission.


Player participation

Players join games by entering a join code and a display name. You represent and warrant that you are of legal age to form a binding agreement, or that you have parental or guardian consent to use the Service. If your use of the Service is prohibited by applicable law, you are not authorised to use it.


Acceptable use

You agree that you will not:

  • Use offensive, discriminatory, or harassing display names.
  • Submit inappropriate, offensive, threatening, or abusive content during creative gameplay rounds.
  • Harass, bully, or intimidate other players in any way.
  • Attempt to exploit, hack, or disrupt the Service, game rooms, or other players' experiences.
  • Use automated tools, bots, or scripts to interact with the Service.
  • Interfere with the proper functioning of the Service, including placing unreasonable load on our infrastructure.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service.
  • Use the Service for any purpose that violates applicable laws or regulations.

Violation of these rules may result in immediate removal from a game room, suspension of your host account, or termination of your access to the Service.


Content in the Service

AI-generated content

Quiz questions, headlines, and other game content in FunDayTeam are generated by artificial intelligence. While we strive for accuracy and quality, AI-generated content may occasionally contain errors, inaccuracies, or unintended outputs. All game content is provided for entertainment purposes only and should not be relied upon as factual reference. We apply content filtering to minimise inappropriate or sensitive content, and hosts can skip any question at any time.


Player-submitted content

During certain creative rounds, players submit text answers that are displayed to other players in the same game room. By submitting content:

  • You grant FunDayTeam a non-exclusive, royalty-free licence to display your submission to other players in the game room for the duration of the game session.
  • Your submissions are ephemeral — they are not stored after the game session ends.
  • You are responsible for ensuring your submissions comply with the acceptable use rules above.
  • FunDayTeam reserves the right to filter or remove submissions that violate these Terms.

Content safety

FunDayTeam applies automated content filtering to both AI-generated questions and player submissions to maintain a safe environment for workplace teams. Hosts retain the ability to skip any question they deem inappropriate for their group. Players who submit inappropriate content may be removed from the game room by the host.


Service availability

Game rooms in FunDayTeam are ephemeral. If a network connection drops or a technical issue occurs during a game, the game state may be lost. We do not guarantee uninterrupted availability of the Service. We may suspend, modify, or discontinue any part of the Service at any time without prior notice.


Intellectual property

The Service, including its design, code, AI-generated content, and branding, is owned by FunDayTeam and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written consent.


If you believe any content on the Service infringes your copyright, please contact us at hello@nieuventures.com with:

  • A description of the copyrighted work you believe is being infringed.
  • Identification of the material you believe is infringing and where it appears on the Service.
  • Your contact information.
  • A statement that you have a good faith belief that the use is not authorised by the copyright owner.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorised to act on behalf of the copyright owner.

Termination

You may stop using the Service at any time. If you are a host and wish to delete your account, please contact us at hello@nieuventures.com. Please also refer to our Privacy Policy to understand how we handle your data.


We may terminate or suspend your access to the Service at any time, for any reason, including violation of these Terms. FunDayTeam has the sole right to determine whether you are in violation of these Terms.


Provisions that by their nature should survive termination will survive, including: obligations to indemnify us, limitations on our liability, intellectual property provisions, and dispute resolution terms.


Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FUNDAYTEAM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI-GENERATED CONTENT IS PROVIDED FOR ENTERTAINMENT ONLY AND MAY CONTAIN ERRORS OR INACCURACIES.


Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FUNDAYTEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF GAME PROGRESS, OR INTERRUPTION OF SERVICE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.


Any views or statements expressed within the Service, including AI-generated content, are not necessarily the views of FunDayTeam, its directors, employees, or agents. If you encounter errors or issues, please contact us at hello@nieuventures.com.


Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless FunDayTeam, its affiliates, officers, agents, employees, and partners from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from or related to: (a) your use of the Service, (b) your violation of these Terms, or (c) any content you submit through the Service.


FunDayTeam makes no warranty that the Service is free of viruses, malware, or other harmful components. You accept all risk associated with your use of the Service, except where such risk arises from the gross negligence or wilful misconduct of FunDayTeam.


Governing law and jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Service constitutes your consent to the jurisdiction of the South African courts. In the event of any dispute, you consent to the non-exclusive jurisdiction of the High Court of the Republic of South Africa (Western Cape Division, Cape Town). These Terms apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the "CPA"). Nothing in these Terms limits your right to approach any court, tribunal, or forum of competent jurisdiction in terms of the Consumer Protection Act.


Assignment

You may not assign, delegate, or transfer these Terms or your rights under them without FunDayTeam's prior written consent. We may transfer or assign these Terms and our rights and obligations without your consent.


Miscellaneous

The failure of either party to exercise any right under these Terms shall not be deemed a waiver of that right. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect. These Terms constitute the complete and exclusive agreement between you and FunDayTeam regarding the Service, and supersede all prior agreements and understandings relating to the subject matter. You acknowledge that you are not an employee, agent, partner, or joint venture of FunDayTeam and have no authority to bind FunDayTeam in any respect. There are no third-party beneficiaries intended under these Terms.
